Asbestos in Ireland

Asbestos is a fibrous building material that was used extensively for construction and industry from the 1950’s up until the 1980’s, especially for insulation and fireproofing. It also found its way into many households as insulating material for boilers, pipes and loft spaces, and even in consumer products such as ironing board covers and curtains. Any house or public building that has not been built since 2000 may contain asbestos.

While the material is usually safe if left undamaged, it is extremely dangerous if it breaks, deteriorates or is in any other way damaged. This is because it is the asbestos fibres that pose the risk, and if they are released into the air as dust and then inhaled, they can embed in the lungs and lead to asbestosis, pleural thickening, lung disease and lung cancers including mesothelioma.

The dangers of asbestos should never be underestimated, and not only is it very dangerous, it is very elusive. The consequences of asbestos exposure do not affect the victim until years later or much later on in life, and while this could be seen as a positive, it means that anyone can be exposed for a very long time and fail to realize until it is too late.

Asbestos is one of the single biggest cause of work-related death in the Ireland with thousands of more cases ranging from mild lung damage to severe diseases.

Understanding Asbestos Claims

Employers have for a very long time held a legal responsibility to protect workers from exposure to asbestos. This means that if your employer has failed to protect you from exposure, you may be able to make a claim. You do not need to have contracted a disease as the result of exposure to make a claim; you only need to be exposed to be able to make a claim. Many firms offer specific claims services for mesothelioma, asbestosis or pleural thickening, and you can find out more about claiming for these on our website.

In 2012 the UK Supreme Court ruled that for cases of asbestos, a claim can be made from the date of knowledge of exposure, not the date of exposure. So if you contract a disease years after the exposure, you have 3 years from the time you are diagnosed to make a claim. If someone dies and a post-mortem reveals asbestos was the cause, relatives have 3 years from that point to make a claim. The current situation is therefore very advantageous for the victims of exposure or their families to claim for compensation.

The type of claim made will depend on your circumstances, with two major routes to follow: a provisional claim or a full claim. In cases where you have been exposed recently and have not developed any problems, the law allows you to make a provisional claim against the responsible party for immediate compensation. The provisional compensation will reflect the level of exposure, and the amount awarded will be less than that from a full claim. If in the future however you develop lung problems that are the result of your exposure, you are then able to make a new damages claim and gain more compensation from the responsible party.

You can choose instead to make a full claim from the very beginning, or make a full claim if you develop problems which you are able to link back to asbestos exposure in the past. The compensation provided with a full claim is always more than the sum of a provisional claim and a subsequent damages claim. Relations, partners and dependants of diseased victims of asbestos exposure may be able to claim on the deceased’s behalf.

Like every other type of personal injury and exposure litigation, you must be able to prove that your employer has neglected their duty to keep you safe from asbestos exposure. This means you need to provide details of the workplace where the exposure occurred and where the asbestos originated from, working practises and so on. In cases where the exposure happened a long time in the past, the employer can be traced with their employer liability insurance or public liability insurance, even if the employer has since moved location or has closed down.

Contrary to earlier studies, exposure to only small amounts of asbestos can lead to diseases and cancer. Those most at risk are engineers, construction and demolition workers, maintenance workers and other contractors who work on older buildings.

What is Mesothelioma?

Mesothelioma is a rare form of cancer that is almost always caused by the exposure to asbestos. Mesothelioma cells appear the mesothelial cells that comprise the mesothelium (protective tissue which covers the internal organs), with most cases beginning in the outer lining of the lungs. Symptoms include chest and abdominal pain, shortness of breath, fatigue, coughing, pleural effusion, and weight loss.

Mesothelioma is a terminal cancer with marginal rates of survival, though if it is detected early on then surgery and chemotherapy can be used to prolong life to some degree. Lung cancers linked to asbestos are malignant, causing more deaths in the UK each year than deaths caused by road accidents.

In UK there were 2,347 registered deaths from Mesothelioma in 2010, and an estimated 2,000 further deaths for Asbestos related lung cancers.

Asbestos Compensation Ireland

There are a number of claim options for the victims of mesothelioma and family members of deceased victims. A recent ruling by the Supreme Court allows victims to claim from the point they realize they have an Asbestos related illness, regardless of when the exposure took place.  Personal Injury claimants now a have a three year window to make a claim, from the point of mesothelioma diagnosis. In fatal cases, there is a three year window to make a claim from the date of death or post-mortem.

The Government offers Industrial Injuries Disablement Benefit for mesothelioma, which is an easy route to receiving financial support for work related exposure. However, following a full claims process for industrial disease will often award higher amounts of compensation. Industrial disease claims can be made with a solicitor, either as a provisional or full claim. The seriousness of mesothelioma and the fact that it forms a long time after exposure means that a full claims process is often the best option.

If a victim of exposure has made a provisional claim for exposure in the past and has since developed mesothelioma, then they will be able to make another claim against the same defendant as before. So if you or a relative have already received provisional compensation in the past, you still have a case for further compensation.

Making a Mesothelioma Claim

For all cases of lung cancer, asbestosis and mesothelioma, it is always important to gain the knowledge and advice of an independent and unbiased solicitor. A solicitor can help you track down the insurance provider for the company in question, and pinpoint when and where the exposure took place. This is very important for mesothelioma and other diseases that take a long time to develop after exposure. Your old employer may have moved or closed for good, but with a solicitor you are able to uncover the important details and build a strong case for compensation.
